Аннотация: | Исследованы теоретические основы недобросовестной налоговой конкуренции, которая проявляется чаще всего в виде применения налоговых льгот, вызывающих негативные налоговые экстерналии. Приведены критерии недобросовестной налоговой конкуренции, разработанные специалистами ЕС и ОЭСР. Рассмотрены негативные налоговые экстерналии, обусловленные предоставлением налоговых льгот. С помощью игровой модели «дилемма заключенного» проанализированы различные варианты налогового поведения государств, следствием которого может быть недобросовестная налоговая конкуренция. |
Описание: | In the current context countries face tax competition. It is conditioned by globalization frame-work, which causes the mobility of labour and capital. The most widespread way of tax competition is
to provide different forms of tax incentives. But if such tax competition induces the negative fiscal externalities one can talk about harmful tax practices.
The article analyzes the theoretical frame-work of harmful tax competition, which occurs as a result of provision of tax incentives.
OECD and EU have been made substantial
efforts to determine the harmful tax competition and to elaborate the guidelines aimed to avoid this malpractice. In the article we examine the clauses of EU’s Code of Conduct for business taxation and
OECD’s issue of harmful tax competition, concerning the characteristics of harmful tax regimes.
We considered the idea of Tiebout’s model of
tax competition to define the framework of harmful tax practice, induced by provision of tax incentives.
Based on analysis of existing research we distinguished four types of negatives tax externalities caused by harmful tax competition. The game theory
tools, particularly “prisoner’s dilemma”, allowed examining the behavior of two jurisdictions, able to provide tax incentives. If countries tend to accelerate
tax rates cuts, the situation of “race to the bottom” that provides reducing countries’ outcome arises.
Another problem, induced by harmful tax competition, is the “winner’s curse” problem, arising due to incomplete (asymmetric) information, provided by
interested policymakers, especially if they can grant discretionary tax benefits.
So the necessity of cooperation in the frame-work of tax cooperation arises. That affects on development of rules and guidelines aimed to restrict the harmful tax practice; that will be the subject of
future research. |
